Hereinafter referred to as the “Seller” or “100 ULIVI”. When you purchase a product through this website, you are the “Client” or “Buyer”.

Hereinafter we present information related to the purchase, delivery, payment process and returns.

SAFE SHOPPING

The data you send to our site when you make an online payment is encrypted, which prevents data interception during transmission. We use the SSL certificate to give you the assurance that any purchase on the site is secure. The use of the certificate can be easily verified because a small padlock appears next to the link in the browser. Also, an SSL-secured address begins with https and not http.

For orders paid online with a card, we use the services of a trusted payment processor. Any payment information is encrypted.

100 ULIVI will ensure that the delivery is made in good condition and in complete confidentiality to the address indicated by you. 100 ULIVI takes care that, once the order is completed, your products are carefully prepared and packaged before shipping.

HOW DO I BUY?

• To order the products presented on this site, you can do it both directly from the site and by phone at +39 388 884 8898/ +40 724 271 183  or by email at office@100ulivi.it , but it is mandatory to provide a phone number and a valid email address through which we can communicate with you. To complete the order, it is also necessary to agree to the Terms and Conditions of the site and the Privacy Policy regarding the processing of your personal data.

• When ordering online, you also have the option to order directly, without having an account on the website

• Select your favorite product and add it to the shopping cart.

• The products in the cart can be seen at any time by accessing the “shopping cart” button

• Fill out the form with the requested personal data, delivery address, choose the payment method and read / complete the other requirements.

• Your order will be confirmed and shipped only after confirmation of payment registration (in the case of online payment by card) or successful completion of the transaction (in the case of orders by phone or email- issuance and payment of the proforma invoice).

The ordered products will be delivered to you depending on stock availability, through a specialized courier company. Delivery will be made within 2-3 working days from the placement of the order for the products in stock, except in special cases in which we will inform you via email (holidays, busy periods, other unforeseen events, etc.)

• All ordered products will be accompanied by a tax invoice.

HOW DO I PAY?

100 ULIVI offers you two methods through which you can pay for products purchased on this site:

1. Payment to bank account, with confirmation – after placing the order by phone or by email, by issuing a proforma invoice.

2. Online payment by card – payment is made by redirecting from the order page to the secure page of the payment processor, where you will safely enter the data on the card with which you wish to make the payment.

DELIVERY INFORMATION

• The delivery time for products in stock is 2-3 working days from the moment of placing the order and paying for the products, until their delivery to the address provided, on the territory of Romania. Deliveries are not made on Saturdays or Sundays, on legal holidays or non-bank days.

• The shipping cost is calculated when placing the order

• Occasionally there might be delays due to factors beyond our control, such as overcrowding of the courier company, the large number of orders due to promotional campaigns (e.g. Black Friday), legal holidays, etc. In these situations, which are not limited to those mentioned, the delivery of the products will be made within a maximum of 15 days from the validation of all order details.

• 100 Ulivi will ensure that the delivery is made in good transport conditions to the address indicated by the buyer. The order can also be validated by phone or online (by email) by our operators involved.

• The seller delivers orders to and from the territory of Romania.

• ​​Delivery is made from Monday to Friday, between 09:00 and 18:00. Please provide an address where you will be at during this time and make sure you leave us a phone number where the courier can contact you.

• For dissatisfaction and complaints regarding the delivery services of the partner delivery company, please contact us at the email address: office@100ulivi.it. We cannot be held responsible for damages caused by delays in the delivery of orders due to external factors: special weather conditions, road accidents, strikes, disasters, street demonstrations or other special situations that could prevent the courier from delivering on time, for which reason 100 ULIVI will not pay compensation for damages caused by the failure to deliver the products on time caused by external factors.

• Courier companies are not authorized by 100 ULIVI to allow the buyer to open the packages before signing for delivery, but only after signing for delivery. After signing for delivery, it is considered that the delivery has been completed, and the buyer has taken possession of the ordered products.

RIGHT OF WITHDRAWAL FROM THE CONTRACT AND RETURNS

According to the legislation in force, any customer, natural person may withdraw from the contract, respectively may give up the purchase or may return a product, within a maximum period of 14 calendar days from the delivery of the product, without invoking any reason, without incurring any costs other than those of return delivery.

Note on the return of food products:

According to the legislation in force (ord. 34/2014 supplemented by law 51/2003 on the legal regime of distance contracts – art. 12, point a) and Directive 97/7/EC of the European Parliament and of the Council of 20.05.1997 on the protection of consumers in respect of distance contracts – art. 3, point (2), first paragraph) contracts for the supply of food products, beverages or other consumer goods supplied to the consumer’s home, residence or workplace by established distributors cannot be terminated unilaterally. Once the products have been received, they cannot be returned.

Products that cannot be returned:

sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer.

• products that are, after delivery, according to their nature, inseparably mixed with other elements.

• food products in the butchery and fish (frozen or fresh), vegetable-fruit, bakery products as well as fresh food products including milk and dairy products, cheese, eggs, etc. and any other food or non-food products that are susceptible to deterioration or expire quickly.

• tobacco and alcohol products and hygiene and any other products that have been unsealed.

• products or services whose price depends on fluctuations in the financial market that the professional cannot control and that may occur during the withdrawal period

• excise products marked with stamps, bands or any other type of specific marking applied according to legal provisions, whose markings have been damaged (alcohol, cigarettes)

In cele ce urmeaza este denumit “Vanzatorul”  sau  “ 100 ULIVI”. Dumneavoastra, atunci cand achizitionati un produs prin intermediul acestui site sunteti “Clientul” sau “Cumparatorul”.

In cele ce urmeaza va prezentam informatii legate de procesul de cumparare, livrare, plata si retur.

CUMPARATURI IN SIGURANTA

Datele transmise de catre dumneavoastra catre site-ul nostru atunci cand efectuati o plata online sunt criptate, ceea ce previne interceptarea datelor pe traseul transmisiei. Folosim certificatul SSL pentru a va oferi siguranta ca orice achizitie de pe site este securizata. Utilizarea certificatului poate fi verificata cu usurinta deoarece lânga link-ul din browser apare un mic lacat. De asemenea, o adresa securizata prin SSL începe cu https si nu cu http.

Pentru comenzile platite online cu cardul, folosim serviciile sigure ale procesatorului de plati. Orice informatii privitoare la plati sunt criptate.

100 ULIVI se va asigura ca livrarea se realizeaza în bune conditii si în deplina confidentialitate la adresa indicata de catre dvs.  100 ULIVI are grija ca, odata finalizata comanda, produsele dumneavoastra sa fie pregatite si ambalate cu atentie înainte de expediere.

CUM CUMPAR?

• La comanda online aveti si optiunea sa comandati direct, fara a detine un cont pe site

• Selectati produsul preferat si dati adaugare în cosul de cumparaturi.

• Produsele din cos pot fi vazute în orice moment prin accesarea butonului  “cosul de cumparaturi”

• Completati formularul cu datele personale solicitate, adresa de livrare, alegeti metoda de plata cu cardul si cititi / completati celelalte cerinte.

• Comanda dumneavoastra  va fi confirmata si expediata doar dupa confirmarea inregistrarii platii (în cazul platii online cu cardul) sau finalizarea cu succes a tranzactiei (în cazul comenzilor prin telefon sau email, emiterea si plata facturii proforme).

• Produsele comandate va vor fi livrate în functie de disponibilitatea stocului, prin intermediul unei firme specializate de curierat. Livrarea se va face în 2-3 zile lucratoare de la confirmarea comenzii pentru produsele aflate pe stoc, cu exceptia cazurilor speciale in care va vom informa prin intermediul unui email ( sarbatori, perioade aglomerate, alte evenimente neprevazute, etc)

• Toate produsele comandate vor fi însotite de factura fiscala.

CUM PLATESC?

100 ULIVI va pune la dispozitie doua metode prin care puteti efectua plata produselor achizitionate de pe acest site:

1. Plata in cont bancar, cu confirmare- dupa plasarea comenzii telefonice sau prin email, prin emiterea unei facturi proforme.

2. Plata online cu cardul – plata se efectueaza prin redirectionarea din pagina de comanda catre pagina securizata a procesatorului de plati Netopia Payments, unde veti introduce în siguranta, datele de pe cardul cu care doriti sa efectuati plata.

INFORMATII DESPRE LIVRARE

• Termenul de livrare pentru produsele aflate pe stoc este de 2-3 zile lucratoare din momentul plasarii comenzii si achitarea produselor, pâna la livrarea acestora la adresa de livrare furnizata, pe teritoriul Romaniei . Nu se efectueaza livrari în zilele de sâmbata sau duminica, în zile de sarbatoare legala sau zile nebancare.

• Costul de de transport este calculat la plasarea comenzii

• Ocazional exista posibilitatea întârzierilor produse din cauza unor factori ce nu tin de noi, precum supra aglomerarea firmei de curierat, numar mare de comenzi datorat campaniilor promotionale (ex: Black Friday), sarbatori legale etc. În aceste situatii, care nu se limiteaza la cele mentionate, livrarea produselor se va efectua într-un termen de maxim 15 zile de la validarea tuturor detaliilor comenzii

• 100 Ulivi se va asigura ca livrarea se realizeaza în bune conditii de transport la adresa indicata de cumparator. Validarea comenzii se poate realiza de asemenea prin telefon sau online (pe email) de catre operatorii nostri implicati.

• Vânzatorul livreaza comenzi  pe si de pe teritoriul României.

• ​​Livrarea se efectueaza de luni pâna vineri, în intervalul orar 09.00 – 18.00. Va rugam sa comunicati o adresa la care veti fi în acest interval de timp si sa va asigurati ca ne lasati un numar de telefon la care curierul va poate contacta.

• Pentru nemultumiri si reclamatii legate de serviciile de livrare ale firmei de livrari partenera, va rugam sa ne contactati la adresa de email: office@100ulivi.it.   Nu putem fi responsabili pentru prejudicii cauzate de întârzieri în livrarea comenzilor din cauza unor factori externi: conditii meteo deosebite, accidente rutiere, greve, calamitati, manifestari de strada sau alte situatii speciale ce ar putea împiedica curierul sa livreze la timp, fapt pentru care 100 ULIVI nu va plati despagubiri pentru prejudiciile creeate de nelivrarea la timp a produselor cauzate de factori externi.

• Firmele de curierat nu sunt autorizate de catre 100 ULIVI sa permita cumparatorului deschiderea coletelor înainte de semnare de livrare, ci doar ulterior semnarii de livrare. Dupa semnarea de livrare se considera ca livrarea a fost indeplinita si cumparatorul a intrat in posesia produselor comandate.

DREPTUL DE RETRAGERE DIN CONTRACT SI RETURNARI

Conform legislatiei în vigoare, orice client, persoana fizica se poate retrage din contract, respectiv poate renunta la cumparare sau poate returna un produs, în termen de maxim 14 zile calendaristice de la livrarea produsului, fara invocarea vreunui motiv, fara a suporta alte costuri, decât cele de livrare de retur.

Mentiune cu privire la returnarea produselor alimentare:

Conform legislatiei in vigoare (ord. 34/2014 completata de legea 51/2003 cu privire la regimul juridic al contractelor la distanta – art 12, pct a) si Directivei 97/7/CE a Parlamentului European si a Consiliului din 20.05.1997 privind protectia consumatorilor cu privire la contractele la distanta – art 3, pct (2), primul paragraf) contractele de furnizare de produse alimentare, bauturi sau alte bunuri de consum curent furnizate la domiciliului consumatorului, la resedinta acestuia sau la locul sau de munca prin distribuitori stabili nu pot fi denuntate unilateral. O data produsele primite acestea nu mai pot fi returnate.

Produse care nu pot fi returnate:

produse sigilate care nu pot fi returnate din motive de protectie a sanatatii sau din motive de igiena si care au fost desigilate de consumator;

• produse care sunt, dupa livrare, potrivit naturii acestora, inseparabil amestecate cu alte elemente;

• produsele alimentare din categoria macelarie si peste (congelat sau proaspat), legume–fructe, panificatie precum si produsele alimentare proaspete inclusiv lapte si produse lactate, branza, oua etc. si orice alte produse alimentare sau nealimentare care sunt susceptibile a se deteriora sau a expira rapid;

• produsele din tutun si alcool si igiena si orice alte produse care au fost desigilate;

• produsele sau serviciile al caror pret depinde de fluctuatiile de pe piata financiara pe care profesionistul nu le poate controla si care pot avea loc pe parcursul perioadei de retragere

• produsele accizabile marcate cu timbre, banderole sau orice alt tip de marcaj specific aplicat conform prevederilor legale, ale caror marcaje au fost deteriorate (alcool, tigari)
