4. ONLINE ORDERS
A valid email address is required to place an online order on the website www.100ulivi.it. Products are added to the shopping cart and are available for purchase depending on stock. To complete the order in the online store, the secure online payment method with a trusted Payment Processor is chosen.
Completing the order represents the confirmation of the data necessary for the purchase process as correct and true by the buyer, and the consent that he may be contacted by the seller for situations related to the purchase/delivery process.
The order may be canceled by the seller, without the possibility of one party claiming damages from the other, if the bank does not accept the transaction- in the case of online payment- if the data necessary for delivery are not complete or correct or if the transaction is declared invalid by the card processor.

5. CONCLUSION OF THE CONTRACT
Registering an electronic order on the website www.100ulivi.it represents the buyer’s agreement with the communication method used by the company S.C. 100 ULIVI S.R.L. The automatic email confirming receipt of the order does not constitute the conclusion of the contract between the seller and the buyer. The conclusion of the contract takes place only when the invoice is issued. Confirmation of the issuance of the invoice and the shipment of the product is made by email.
The Contract is based on the information of the products made available on the website www.100ulivi.it by S.C. 100 ULIVI S.R.L. and the certificate of conformity posted on the website.
The seller reserves the right to modify the quantity of products in the order or to cancel the buyer’s order, with prior notice , depending on their stock availability. The money collected in advance by the company S.C. 100 ULIVI S.R.L. in this context of cancellation will be refunded within a maximum of 14 days.
6. DELIVERY INFORMATION
The delivery time is of 2-3 working days on the territory of Romania from the moment of order confirmation, applying for the products in stock. Deliveries are not made on Saturdays or Sundays, on legal holidays or non-banking days.
Occasionally there is the possibility of delays caused by factors such as overcrowding of the courier company, large number of orders due to promotional campaigns (e.g. Black Friday), legal holidays, etc. In these situations, which are not limited to those mentioned, the delivery of the products will be made within a maximum period of 15 days from the validation of all order details.
All delivered products are specially packaged for transport and will be accompanied by an invoice.
The seller will ensure that the delivery is made in good conditions and in full confidentiality to the address of the buyer. The order is validated by email by the operators.
The seller delivers orders to and from the territory of Romania.
The delivery cost is calculated when placing the order.
For dissatisfaction and complaints related to delivery services, please contact us at office@100ulivi.it. We cannot be held responsible for damages caused by delays in the delivery of orders due to external factors: special weather conditions, road accidents, strikes, disasters, street demonstrations or other special situations that could prevent timely delivery, for which reason 100 ULIVI will not pay compensation for damages caused by the failure to deliver the products on time.
7. TRANSFER OF PROPERTY
The ownership of the goods and services will be transferred at the time of their delivery to the buyer.
The package containing the ordered products is prepared by the seller and sealed with the utmost care. The courier is not authorized by the seller to allow the buyer to open the packages before signing for delivery, but only after it. The buyer’s obligation is to receive the package only if it is sealed.
8. PRODUCT RETURNS
According to the legislation in force, the withdrawal from the purchase is applicable only to individual customers.
The buyer has the right to notify the merchant in writing that he/she withdraws from the purchase, that is, he/she will return a product, without penalties or additional fees, except for those for delivery and without invoking a reason, within 14 days of receiving the product. The returned product must be in the same condition in which it was delivered (in the original packaging, without being unsealed, with all accessories, with intact labels, etc. and the documents that accompanied it).

Government Ordinance no. 130/2000 stipulates that the return does not apply to the sale of food products, beverages or household products delivered to the consumer’s home.

9. ORDER CANCELLATION
The Seller assumes no responsibility for printing or display errors regarding prices, features or images of the products. If an order cannot be honored due to such errors, the Seller reserves the right to cancel the respective order and notify the Buyer.
100 ULIVI makes every effort to provide accurate information about the price and features of the products.
If we discover an error in the price or stock of any products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or stock or to cancel it. If we are unable to contact you, your order will be treated as canceled. If you cancel and have already paid for the products, you will receive a full refund as soon as possible.
The seller reserves the right to cancel the order, without any further obligation from either party to the other or without any party being able to claim damages from the other, in the following situations:
– the ridiculous prices incorrectly displayed on the website www.100ulivi.it are the result of a technical error
– the product(s) ordered are no longer in stock.
– the transaction was not accepted by the bank issuing the buyer’s card.
– the data provided by the buyer on the website are incomplete and/or incorrect
– following the telephone order or by email the proforma invoice was not paid within a maximum of 2 days from the date of issue
10. CONFORMITY
Acceptance will be made when the products shipped comply with the characteristics mentioned in the Order. If the products delivered or the services provided do not comply with the specifications, the seller will bring the products and/or services into conformity within a maximum period of 14 days, without charging the buyer any costs related to these operations.
11. INVOICE
All 100 ULIVI products are accompanied by an invoice.
12. LIMITATION OF LIABILITY
The seller is not responsible for the use of the goods after their delivery or for their loss.

Cumparatorul/ Clientul este persoana fizica sau juridica care efectueaza o comanda prin intermediul magazinului online, telefonic ( la numarul de telefon +39 388 884 8898 sau +40 724 271 183) sau prin email ( office@100ulivi.it) , folosind date personale (precum nume, telefon, email, date de identificare, date de contact, adresa de livrare, etc).
Utilizatorul este persoana fizica sau juridica care acceseaza si viziteaza site-ul www.100ulivi.it
Contractul este contractul la distanta care se încheie între cumparator si vânzator.
Comanda este documentul electronic prin intermediul caruia Cumparatorul îsi exprima intentia de a achizitiona produse de pe Site.
1. INFORMATII DESPRE SITE SI PRODUSELE COMERCIALIZATE
Toate informatiile / modalitatile folosite pentru descrierea produselor si serviciilor de pe site nu reprezinta o obligatie contractuala din partea vânzatorului, acestea fiind utilizate exclusiv cu titlu de prezentare. Produsele sunt disponibile în limita stocului. Preturile, ofertele si imaginile pot fi schimbate fara o notificare prealabila.
Informatiile prezentate pe site au caracter informativ si pot fi modificate fara o anuntare prealabila.
2.ACCEPTAREA CONDITIILOR
Utilizarea site-ului www.100ulivi.it si accesarea serviciilor reprezinta acceptarea termenilor si conditiilor si a politicii de confidentialitate care se regasesc pe site. Termenii si Conditiile sunt puse la dispozitie permanent utilizatorului si pot fi consultate oricând.
100 ULIVI îsi rezerva dreptul de a actualiza si/sau revizui Termenii si Conditiile în orice moment fara o notificare prealabila. În acest sens va rugam sa urmariti în mod periodic eventualele modificari.
3.DREPTURILE DE PROPRIETATE INTELECTUALA
Toate materialele integrate in acest site care includ, dar nu se limiteaza la: logo-uri, simboluri comerciale, imagini statice sau dinamice, texte, multimedia, grafice, simboluri, email-uri si alte date, sunt proprietatea intelectuala a S.C. 100 ULIVI S.R.L. Aceste materiale nu pot fi copiate sau reproduse, exceptând perioada de care este nevoie sa fie vizualizate on-line si pot fi folosite doar într-un scop personal, nu comercial.
Nu este permisa transmiterea, copierea, alterarea, modificarea informatiilor publicate pe www.100ulivi.it si expunerea lor într-un context diferit de cel original fara acordul scris acordat în prealabil, al reprezentantului legal al societatii S.C. 100 ULIVI S.R.L., care administreaza site-ul.
4. COMENZI ONLINE
Pentru a realiza o comanda online de pe site-ul www.100ulivi.it este necesara o adresa de email valida. Produsele se adauga în cosul de cumparaturi si sunt disponibile pentru achizitie în functie de stoc. Pentru finalizarea comenzii in magazinul online se alege modalitatea de plata online cu cardul securizata a procesatorului de plati.
Finalizarea comenzii reprezinta confirmarea datelor necesare procesului de cumparare ca fiind corecte si adevarate de catre cumparator si consimtamântul ca poate fi contactat de catre vânzator pentru situatii aferente procesului de cumparare/ livrare.
Comanda poate fi anulata de catre vânzator, fara posibilitatea unei parti de a pretinde celeilalte daune, daca banca nu accepta tranzactia- în cazul platii online-, daca datele necesare livrarii nu sunt complete sau corecte sau daca tranzactia este declarata invalida de catre procesorul de plati.

5. ÎNCHEIEREA CONTRACTULUI
Înregistrarea unei comenzi electronice pe site-ul www.100ulivi.it reprezinta acordul cumparatorului cu modalitatea de comunicare utilizata de societatea S.C. 100 ULIVI S.R.L. Emailul automat de confirmare a primirii comenzii nu echivaleaza cu încheierea contractului între vânzator si cumparator. Încheierea contractului are loc doar în momentul emiterii facturii fiscale. Confirmarea emiterii facturii si a expedierii produsului se face pe email.
La baza Contractului stau informatiile despre produse puse la dispozitie pe site-ul www.100ulivi.it de catre S.C. 100 ULIVI S.R.L. si certificatul de conformitate al acestora disponibil pe site .
Vânzatorul îsi rezerva dreptul de a modifica cantitatea produselor din comanda, cat si de a anula comanda cumparatorului în functie de disponibilitatea lor în stoc, cu o notificare prealabila. Banii încasati in avans de societatea S.C. 100 ULIVI S.R.L. în acest context de anulare vor fi restituiti în termen de maxim 14 zile.
6. INFORMATII LIVRARE
Termenul de livrare este de 2-3 zile lucratoare pe teritoriul Romaniei din momentul confirmarii comenzii, aplicandu-se pentru produsele aflate in stoc. Livrările nu se fac sâmbăta sau duminica, în zilele de sărbătoare legală sau zile nebancare.
Ocazional exista posibilitatea întârzierilor produse de factori precum supraaglomerarea firmei de curierat, numar mare de comenzi datorat campaniilor promotionale (ex: Black Friday), sarbatori legale etc. În aceste situatii, care nu se limiteaza la cele mentionate, livrarea produselor se va efectua într-un termen de maxim 15 de zile de la validarea tuturor detaliilor comenzii.
Toate produsele livrate sunt ambalate special de transport si vor fi însotite de factura.
Vânzatorul se va asigura ca livrarea se realizeaza în bune conditii si în deplina confidentialitate la adresa cumparatorului. Validarea comenzii se realizeaza prin email de catre operatori.
Vânzatorul livreaza comenzi pe si de pe teritoriul României.
Costul de livrare se calculeaza la plasarea comenzii.
Pentru nemultumiri si reclamatii legate de serviciile de livrare, va rugam sa ne contactati la office@100ulivi.it. Nu putem fi responsabili pentru prejudicii cauzate de întârzieri în livrarea comenzilor din cauza unor factori externi: conditii meteo deosebite, accidente rutiere, greve, calamitati, manifestari de strada sau alte situatii speciale ce ar putea împiedica livrarea la timp, fapt pentru care 100 ULIVI nu va plati despagubiri pentru prejudiciile creeate de nelivrarea la timp a produselor.
7. TRANSFERUL PROPRIETATII
Proprietatea asupra bunurilor si serviciilor va fi transferata la momentul livrarii acestora catre cumparator.
Coletul continând produsele comandate este pregatit de vânzator si sigilat sub cea mai mare atentie. Curierul nu este autorizat de catre vânzator sa permita cumparatorului deschiderea coletelor înainte de semnarea de livrare, ci doar ulterior acesteia. Obligatia cumparatorului este sa primeasca coletul doar daca acesta este sigilat.
8. RETURNARI DE PRODUSE
Conform legislatiei în vigoare, renuntarea la cumparare este aplicabila doar clientilor persoane fizice.
Cumparatorul are dreptul sa notifice în scris comerciantul ca renunta la cumparare, adica va returna un produs, fara penalitati sau taxe suplimentare, cu exceptia celor de livrare si fara invocarea unui motiv, în termen de 14 zile de la primirea produsului. Produsul returnat trebuie sa fie în aceeasi stare în care a fost livrat (în ambalajul original, fara a fi desigilat, cu toate accesoriile, cu etichetele intacte, etc si documentele care l-au însotit).
Excepții pentru produsele alimentare:
Ordonanța Guvernului nr. 130/2000 stipulează că returnarea nu se aplică în cazul vânzării de produse alimentare, băuturi sau produse de uz curent utilizate în gospodărie livrate la domiciliul consumatorului.

9. ANULARE COMANDA
Vânzatorul nu îsi asuma responsabilitatea pentru greselile de tiparire sau afisare referitoare la preturile, caracteristicile sau imaginile produselor. În cazul în care o comanda nu poate fi onorata din cauza unor astfel de erori, vânzatorul îsi rezerva dreptul de a anula comanda respectiva si de a anunta Cumparatorul.
100 ULIVI face toate eforturile pentru a furniza informatii corecte despre pretul si caracteristicile produselor.
Daca descoperim o eroare în pretul sau stocul oricaror produse pe care le-ati comandat, va vom informa în cel mai scurt timp posibil si va vom oferi optiunea de a va reconfirma comanda la pretul sau stocul corect sau de a o anula. Daca nu va putem contacta, comanda dumneavoastra va fi tratata ca anulata. Daca anulati si ati platit deja pentru produse, veti primi o rambursare completa cât mai curând posibil.
Vânzatorul îsi rezerva dreptul de a anula comanda, fara nicio obligatie ulterioara a vreunei parti una fata de cealalta sau fara ca vreo parte sa poata sa pretinda celeilalte daune-interese, în urmatoarele situatii:
– preturile derizorii afisate gresit pe site-ul www.100ulivi.it sunt rezultatul unei erori tehnice
– produsul / produsele comandat(e) nu se mai afla pe stoc;
– tranzactia nu a fost acceptata de catre banca emitenta a cardului cumparatorului;
– datele furnizate de catre cumparator, pe site sunt incomplete si/sau incorecte
– în urma unei comenzi telefonice sau prin email factura proforma nu a fost achitata în termen de maxim 2 zile de la data emiterii
10. CONFORMITATE
Acceptarea va fi facuta atunci cand produsele expediate sunt conforme cu caracteristicile mentionate în Comanda. În cazul în care produsele livrate sau serviciile furnizate nu sunt conforme specificatiilor, vânzatorul va aduce la conformitate produsele si / sau serviciile într-un termen maxim de 14 zile, fara a imputa cumparatorului eventuale costuri legate de aceste operatiuni.
11. FACTURARE
Toate produsele 100 ULIVI sunt însotite de factura fiscala.
12. LIMITARE RASPUNDERE
Vânzatorul nu este responsabil de utilizarea bunurilor dupa livrare si nici pentru pierderea acestora.
Site-ul www.100ulivi.it si software-urile utilizate în cadrul site-ului sunt furnizate în modalitatea în care se gasesc si atât cât sunt disponibile, fara niciun fel de garantii, exprese sau implicite.
Nu ne asumam raspunderea pentru modificarea, suspendarea sau întreruperea site-ului www.100ulivi.it
13. LEGI SI JURISDICTII
Acest site functioneaza în concordanta cu legile în vigoare în Romania. Pentru reglarea oricaror dispute referitoare la acest site, legile si tribunalele din Romania vor avea jurisdictie exclusiva.
